Mr. Martinson practices all aspects of employment and ERISA law. He represents employers in every stage of discrimination litigation both in state and federal administrative proceedings and in state and federal court. He represents national and local employers in drafting employment applications, policies, handbooks and agreements. Mr. Martinson also has extensive experience in ERISA litigation and represents self-funded and insured ERISA plans, including plan insurers, administrators, and fiduciaries. He is admitted to the Utah State Bar, the U.S. District Court for the District of Utah, the Federal Circuit Courts of Appeal for the Federal and Tenth Circuits, and is a member of the American Bar Association and the Federal Bar Association.
He received his Juris Doctor Degree from the University of Utah College of Law (1989), where he was a teaching assistant in legal writing (1988-1989), a tutor in constitutional law (1987-1989), the William H. Leary Scholar in American Jurisprudence and received the Philosophy of Law award in 1988. He received his Bachelor of Arts degree in English from the University of Utah in 1985. Mr. Martinson has been a shareholder at Fabian & Clendenin from 1998 to the present. Previous to that position, he was the Translation Supervisor at the Tahiti Translation Office for the LDS Church in Papeete, Tahiti from 1994-1998. From 1993-1994 he was the in-house attorney for JB’s Restaurants, Inc., an associate at Campbell Maack & Sessions (1990-1993), an associate at Watkiss & Saperstein (1989-1990), and a Police Officer, Detective and Sergeant for the Salt Lake City Police Department from 1980-1989.
