Kevin is one of our most experienced trial attorneys and is also an active mediator and arbitrator. With over twenty-six years of litigation experience in state and federal courts, arbitration and administrative forums, Kevin has experience in a variety of complex commercial disputes, with a substantial portion of that representing electric utilities and other energy-related companies in diverse litigation, arbitration and regulatory matters. Kevin has long been involved in all aspects of long term coal supply agreements: negotiation, litigation, arbitration and mediation. He has also advised utilities on various aspects of resource planning, renewable energy and issues surrounding the construction of new power plants. These efforts have helped utilities remain competitive by substantially lowering their fuel costs by tens of millions of dollars.
Kevin has also handled matters involving contract disputes, force majeure, eminent domain and condemnation, securities fraud, insurance coverage and benefits, banking, real estate transactions, fiduciary relationships and Indian law. He has taken on the FBI and the NCAA, represented Victoria’s Secret and helped an elderly widow get out of an onerous contract with a real estate developer and avoid a city’s attempt to take part of her land.
Kevin was admitted to the Utah State Bar in 1981, to the Nevada State Bar in 1992 and to the District of Columbia Bar in 2005. He is admitted to the Tenth Circuit Court of Appeals and has served on the Utah Supreme Court Advisory Committee on Civil Procedure. He received his Juris Doctorate from Georgetown University Law Center in 1981 and his Bachelor of Arts from the University of Utah in 1978.
