Christian D. Austin
Christian Austin is a shareholder in Fabian and an accomplished and aggressive trial lawyer with a broad background in complex commercial litigation, with emphasis on litigation arising from business torts, contract rights, employment, real estate development, commercial and mortgage lending.
Christian represents local and national business clients including developers, contractors, banks, title insurance underwriters and many others.
He also has extensive experience representing severely injured clients in wrongful death, brain, spinal cord and other catastrophic injury claims arising from medical malpractice, product liability, auto accidents and other negligence.
In recognition of his exceptional and uncompromising advocacy, Christian has been selected by his attorney peers and Utah Business magazine as one of "Utah's Legal Elite" practitioners.
While he is a skilled litigator, Christian is also experienced in various forms of alternative dispute resolution including mediation and arbitration, and his work on the subject has been published in The Utah Labor Letter.
Christian received his J.D. degree, Summa Cum Laude (top 2%), from Brigham Young University's J. Reuben Clark law school where he served as senior editor for BYU Law Review and was inducted into the Order of the Coif. Christian is a member of the Utah State Bar and is admitted to practice before Utah's state and federal courts.

- COMMERCIAL LITIGATION - Christian has practiced extensively in a wide range of commercial disputes, including breach of contract, real property, non-competition agreements and commercial banking cases. He represented a major university in appealing the decision of the NCAA to promulgate a policy regarding the use of Native American imagery, and initiated litigation seeking a temporary and permanent injunction prohibiting the NCAA from enforcing the policy. Overcoming aggressive opposition from the NCAA, Christian successfully obtained a preliminary injunction, leading to an out of court resolution of the litigation on terms favorable to the University. Representing a national mortgage company, Christian successfully defeated a claim for violation of federal Truth-In-Lending statutes, by aggressively pursuing summary judgment, promting a favorable settlement. On behalf of a major insurance client, he has successfully prosecuted a breach of contract action seeking payment of funds owed under employee benefits insurance and management contract, resulting in a favorable settlement for the client. For a long-established banking client, Christian prosecuted a sizeable deficiency action in a commercial development loan.
- MEDICAL MALPRACTICE - Christian has represented clients in numerous medically complex medical malpractice actions focusing on claims involving catastrophic injuries and wrongful death. He gets results by aggressively pursuing claims, through jury trial if necessary. Christian has successfully prosecuted numerous complex, hard fought medical malpractice claims, resulting in six and seven-figure settlements, including the following: Prosecuted an action for a wrongful death based upon a physician's improper resuscitation following administration of medication resulting in anoxic brain injury and death, resulting in a very favorable settlement. Prosecuted a medical malpractice action involving failure to timely diagnose and treat intracranial pressure resulting in blindness. Prosecuted a medical malpractice action involving the failure of an emergency room physician to properly diagnose heart attack. Successfully prosecuted an action against a plastic surgeon seeking recovery for wrongful death due to overdose of pain medication.
