Rachel George Terry
Rachel Terry is an associate with a broad background in complex commercial litigation, with an emphasis on litigation arising from business torts, contract rights, mining and utilities, and real property. Her practice also focuses on appellate law, and she has experience handling cases before the Utah Supreme Court, and Tenth Circuit Court of Appeals. Rachel represents local and national business clients, including a national construction company, banks, a coal company, and title insurance underwriters.
Prior to joining Fabian, Rachel was an extern for Judge Dee Benson and Judge Paul Casell of the U.S. District Court of Utah. Rachel is active in the community. In 2008, she implemented the Wills for Heroes program throughout the State of Utah. The program provides free estate planning services for first responders.

- LITIGATION - The amount at stake in Rachel's cases ranges from a few thousand dollars to millions of dollars. Recently, Rachel was successful in obtaining a large settlement against a global technology company for claims arising out of a breach of oral contract. She is currently working with a team of litigators in defending a major coal producer against claims arising from a highly publicized mine disaster. With potentially millions of dollars at stake, her team has handled the defense using an aggressive and efficient strategy. Rachel's work on the case has included monitoring a state investigation, managing complex discovery, and consulting on trial strategy.
- CONSTRUCTION LAW - Rachel represents a national construction company in defending construction defects and fighting for improperly withheld payments.
- REAL ESTATE LAW - Rachel has represented banks and individual property owners in dealing with disputes arising out of development, financing, and liens affecting commercial and residential real property.
- APPEALS - Appeals require careful attention to nuances in the laws and regulations governing a given case and should not be treated as just another step in litigation. Rachel has experience with cases before the Utah Supreme Court and Tenth Circuit Court of Appeals.
