Mr. Petersen practices all aspects of employment and ERISA law. He represents employers in every stage of discrimination litigation both in state and federal administrative proceedings and in state and federal court. He represents national and local employers in drafting employment applications, policies, handbooks and agreements. Mr. Petersen also has extensive experience in ERISA litigation and represents self-funded and insured ERISA plans, including plan insurers, administrators, and fiduciaries. He has litigated cases involving employment discrimination and benefits including Title VII, ADA, ADEA, FMLA, FLSA, ERISA, COBRA, and others. Mr. Petersen is admitted to practice in all Utah state and federal courts, the Court of Appeals for the Tenth Circuit, and the United States Supreme Court. He is a member of the Utah State Bar and the American Bar Association.
Mr. Petersen has been admitted to the Utah State Bar (1996), the Tenth Circuit Court of Appeals (1998), the US Supreme Court (2000), is a member of the American Bar Association and the David K. Watkiss—Sutherland Inn II American Inns of Court. He received his Bachelor of Arts, cum laude, from Brigham Young University in 1991, his Master of Arts from Arizona State University in 1992 and his Juris Doctor from the J. Reuben Clark Law School, Brigham Young University in 1996. He was Order of the Coif, on the Law Review from 1995-1996, and a member of the National Moot Court Team from 1994-1995. Mr. Petersen is the author or co-author of the following publications: Aging Workforce Alert: Considerations Under the ADEA 6 Utah Labor Letter 6 (2000); Employee Absenteeism Under the ADA—When is Enough, Enough? 5 Utah Labor Letter 6 (1999); Supreme Court Voting behavior: 1994 Term, 23 Hastings Const. Mr. Petersen was a law clerk in the US Attorney’s office (1994), the Orem City Attorney’s Office (1994-1995), and a research assistant for Professor Richard G. Wilkings at BYU (1994-1996). He was employed at Strong and Hanni from 1995 to 1997, and has been at Fabian & Clendenin since that time, as an associate from 1997-2000 and as a shareholder from 2000 to the present.
