Bankruptcy
Fabian’s bankruptcy practice is one of Salt Lake’s largest and has extensive experience in representing trustees, creditors’ committees, secured lenders, and debtors in possession. By representing both creditors and debtors/trustees, Fabian’s ability to effectively represent our clients is enhanced — particularly since bankruptcy requires an understanding of the rights and interests of all parties to the bankruptcy proceeding. The group is led by Gary E. Jubber, who also serves as a Chapter 7 bankruptcy trustee.
Fabian’s practice is primarily focused on Chapter 11 and Chapter 7 cases. That representation involves representation of the debtor or the trustee or, in some cases, the representation of parties seeking to purchase property from a bankruptcy estate, seeking to lend money to a bankruptcy estate, or having title disputes with a bankruptcy estate. The firm has also represented clients in workouts, some of which have resulted in avoiding the need to file a bankruptcy proceeding.
Chapter 11 Areas:
- Petition, Schedules and Statements of Affairs
- First Day Motions — Use of Cash Collateral
- Motions to Incur Debt
- Motions to Sell Property
- Formulation and Confirmation of a Plan of Reorganization and Preparation of a Disclosure Statement
- Disclosure Statement
Bankruptcy Litigation:
- Avoidance Actions: Preferences, Fraudulent Conveyances
- Motions for Relief from Stay
- Motions to Assume or Reject Executory Contracts
- Claim Objection
- Fee Disputes
